Free Money Fly-Aways

Fall 2012

1. WHO MAY PLAY
No purchase is necessary to enter or win.

Must be at least 18 years of age or over. Legal photo ID required. Contest open only to legal Florida residents except employees of Cox Enterprises, Inc. /Cox Media Group and it’s partially and fully owned subsidiaries and participating sponsor(s) and the immediate families of those employees. The term “immediate family members” includes spouses, parents, grandparents, siblings, children, and grandchildren. No other local radio company employees may play. A person may only win once during this contest and only one winner per household. No purchase necessary to enter or win. A purchase will not improve your chances of winning. All federal, local and municipal laws and regulations apply. Void where prohibited.

2. CONDITIONS OF WINNING
Official rules are available at the 107.3 Eagle (WXGL) studio at 11300 4^th Street N., Ste. 300 St. Petersburg FL 33716, from 8:30am-5:30pm (EST) Monday through Friday (subject to holidays, early closings at our discretion). Official rules are also available at www.1073theeagle.com. By entering the contest, contestants give permission for their name, photo and/or voice to be used for promotional purposes without compensation. Winners must sign promotional release form as condition of receiving prize. Winner is responsible for all taxes. Prizes must be claimed in person, by the actual winner, at the 107.3 Eagle (WXGL) business office within 30 business days or be forfeited. A person may not play the "Eagle Free Money Fly-Away" contest if they have won a contest with 107.3 Eagle in the previous 30 days.

Select fly-away trips (Vancouver and cruises) require the winner and guest to have valid passports.  If a cash winner also wins a trip that requires a valid passport, then it is 100% completely the responsibility of the contest winner and their guest, to provide a valid passport. If they cannot provide a valid passport, then the fly-away trip will be forfeited.  WXGL and Cox Media Group are not in any way responsible for this and substitution trips are not allowed. 
Free Money Fly-Away Winners are not eligible to win any contest on 107.3 Eagle (WXGL) for 30 days. Additionally, all Free Money Fly-Away prize winners may only win once during this contest; one winner per household.

3. TECHNICAL ISSUES

107.3 Eagle (WXGL) will not be responsible for loss of service to the call-in line or for a contestant’s failure to reach the call-in line due to malfunction of any network or system, congestion, overload, busy signals, or any other factor that may prevent an individual from completing his/her phone call. In the event of interruption of power or telephone service to 107.3 Eagle (WXGL) during a call-in period of 8am and 6pm the 107.3 Eagle “Free Money Fly-Away” and prior to accepting the winning caller, the call-in period affected by the interruption may or may not be replayed at the resumption of service, at 107.3 Eagle’s sole discretion. The use of automatic telephone dialing equipment or other software or computer assisted dialing equipment is prohibited and will result in disqualification. In the event that there is a technical problem with the telephones or equipment beyond 107.3 Eagle’s control during the contest, the contest will cease at that moment and all parties on the line will be disconnected. 107.3 Eagle reserves the right to suspend the contest at any time due to weather emergencies, acts of terrorism or war, technical difficulties, or any other circumstances beyond the control of 107.3 Eagle. If such suspension takes place, 107.3 Eagle will broadcast the date and time of the resumption of the contest, and information regarding the resumption of the contest will be available at 1073theeagle.com and at the 107.3 Eagle studios at 11300 4^th Street N., Ste. 300 St. Petersburg FL 33716, during regular business hours (Monday through Friday 8:30am to 5:30pm)

4. CONSTRUCTION
The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

5. SPONSOR

The 107.3 Eagle “Free Money Fly-Away” is sponsored by 107.3 the Eagle (WXGL  d.b.a. Cox Media Group, Inc.). The decisions of 107.3 The (WXGL) regarding the selection of winners, the interpretation of these Official Rules and all other aspects of the contest shall be final and binding in all respects. 107.3 Eagle (WXGL) will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the 107.3 Eagle “Free Money Fly-Away”.

6. METHOD OF ENTRY
Beginning October 8, 2012 and lasting through November 30, 2012 107.3 Eagle (WXGL) will encourage the audience to listen each weekday at approximately 8:30am for the Artist of the Day.  When that Artist of the Day plays, in the 9am hour, in the 2pm hour and again in the 5pm hour (E.S.T.), the 10^th caller (each time) will each win $107 cash. Listeners will need to call the designated studio lines at (727) 579-1073 or (813) 229-1073. The tenth caller when the Artist of the Day plays in the 9am hour, in the 2pm hour and again in the 5pm hour will be chosen as the winner of $107 cash prize and will be qualified to win one of 40 Trip Fly-Away packages, which will include round trip airfare for two persons, overnight accommodations and 2 concert tickets to a specified concert, provided that he/she is eligible to participate in the contest. Eligibility must be confirmed, for winner to actually receive the prize. Every $107 winner will be qualified to win one of the 40 trips.  Trip winners will be chosen randomly from all $107 winners and one fly-away trip winner will be announced every weekday at 6:30pm, throughout the course of the contest.  Some designated trips will require the winner and guest to have valid passports.  Winners will only be eligible for such trips if they have a valid passport. WXGL is not responsible for any contest winner not having a valid passport. Only cash winners with a valid passport will be eligible to win select trips, where the destination is outside the United States and a passport is required by law.  If the winner chosen randomly for a fly-away does not have the required valid passport, then they will forfeit the fly-away. No substitutions or alternative prizes will be made available  107.3 Eagle is not responsible for the winner being unable to take a trip.  Trips may not be changed, exchanged, swapped on the part of the winner.  107.3 Eagle reserves the right to alter the contest execution at any time. If a trip winner opts to extend their trip, they will be solely responsible for any additional charges (hotel, airline fees, ground transportation, food, etc).  WXGL will not be responsible for any additional costs incurred on a fly-away trip by winner and/or guest.   WXGL reserves the right to give away additional fly-away trips throughout the course of this contest period, either on-air, on-line or via social media.  WXGL reserves the right to lengthen or shorten the total contest period.

Due to delays and buffering in the online streaming of the Station’s broadcast signal, listeners to the online stream may not be able to timely participate in or may be disadvantaged when participating in on-air contests.  Entrants are encouraged to listen to the Station for the Cues on-air.  The Promotion Entities are not responsible for online streaming delays.

7. ODDS OF WINNING

 The odds of winning depend on the total number of eligible contestants who enter the Giveaway during any particular contest occasion.

8. LIMITATIONS OF LIABILITY

By entering the Contest, contestant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys' fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

9. OTHER SPECIFICATIONS
Once winners have been given notification they will have 20 days (business and weekend) to come to the 107.3 Eagle studios during business hours and complete a prize-winning paperwork.  Each winner must provide a valid Florida photo drivers license and sign a tax release from before the said prize will be released.  Prizes are nontransferable.  Winners may waive their right to receive prizes. The winner must be present at the 107.3 Eagle studios to complete his or her own paperwork.  Once the winner’s paperwork has been completed, 107.3 Eagle will submit a payment request through our corporate offices in Atlanta, Georgia.  Payment will then be mailed to the winner at the address provided on their paperwork in approximately 40 business days from the time that their paperwork is completed.  Incomplete or inaccurate information on winner’s paperwork may cause delays in processing winner’s prize. No substitutions are allowed, and 107.3 Eagle reserves the right to substitute prizes of equal or greater value. Trip winners will be contacted by telephone when their trip documentation is ready for pick up.  Proof of a valid Florida’s driver’s license is also required when picking up trip documentation.  Winners are solely responsible for reporting and payment of any taxes on prizes. 107.3 Eagle  may require winners to complete an affidavit of eligibility, and a liability and publicity release. Failure to sign and return the affidavit or release by this date, or to comply with any term or condition of these Official Rules, may, at the discretion of 107.3 Eagle, result in a winner's disqualification, the forfeiture of his/her interest in the prize.  Winner will be allowed to win the Eagle Free Money Fly-Away trip  only once during the 8 week contesting period.  The standard 30 day contest rule does not apply for Free Money Fly-Aways, as a contest winner is only eligible to win one time during this particular contest.  Except where prohibited, participation in the Contest constitutes contestant's consent to the publication of his/her name, likeness, and biographical information in any media for any commercial or promotional purpose, without limitation or further compensation.  Prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. For the name of the winner, send a separate, self-addressed stamped envelope to: “The Eagle Free Money Fly-Away” Winner, 11300 4^th Street N., Ste. 300 St. Petersburg FL 33716.
